People vs. Tammang , 5 C.A. Rep. 145

 It having been established that the boy Jundam was in good health on the morning of the incident; that he was whipped,  spanked and thrown against the post by his teacher , his breast hitting it; that he complained to his mother about the oppressive pain, crying and massaging his breast all the time ; that he was found to have two suspicious bluish spots — a big one on the breast and another one on the upper left arm; and that he vomitted blood until he died three days afterwards; and there bein g no proof of any intervening cause, the  liability of the teacher for homicide necessarily follows from the premise s stated. 

Note: Had it been proved, as claimed by the defense, that the boy died of hydrophobia, that would have constituted an intervening cause, and th e accused would have been acquitted.
